Terms of Service

1. Eligibility and accounts

You must be at least 18 years old and authorized to bind the business you register. You agree to provide accurate information and keep it up to date.

You are responsible for keeping your login credentials and employee PINs confidential and for all activity under your account.

2. The Services

Kinetic Pay provides browser-based software for point of sale, product catalog and inventory, customer records, orders and refunds, invoices, reporting, team management and API access. Features may change over time.

Kinetic Pay is software only. We do not sell or lease payment hardware.

3. Payment processing

Card payments are processed by Stripe, Inc. and its affiliates ("Stripe"). To accept card payments you must agree to the Stripe Connected Account Agreement and Stripe Services Agreement, which govern payment processing, payouts, chargebacks and reserves.

Kinetic Pay is not a bank or money transmitter and does not hold your funds. Payout timing is determined by Stripe.

4. Fees

Subscription and processing fees are described on our pricing page. Subscription fees are billed in advance and are non-refundable except where required by law. We will give notice before changing fees.

You are responsible for any applicable taxes, chargebacks, refunds and related fees arising from your transactions.

5. Acceptable use

You agree not to use the Services for unlawful, fraudulent or prohibited activities, including any business types restricted by Stripe, and not to interfere with or attempt to gain unauthorized access to the Services.

6. Your data

You retain ownership of the business data you enter. You grant us a limited license to process it to provide the Services. Our handling of personal information is described in the Privacy Policy.

7. Termination

You may stop using the Services at any time. We may suspend or terminate accounts that violate these Terms or create risk for us, our providers or other users.

8. Disclaimers and limitation of liability

The Services are provided "as is" without warranties of any kind to the extent permitted by law. To the maximum extent permitted by law, Kinetic Pay will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenues, and our total liability will not exceed the fees you paid us in the 12 months before the claim.

9. Changes

We may update these Terms from time to time. If changes are material, we will notify you by email or in the dashboard. Continued use after changes take effect means you accept the updated Terms.
